According to F.S. 322.091, a student must meet one of the following to be eligible for driving privileges.

Enrollment: Must be enrolled in a public school, nonpublic school, or home education program and meet attendance requirements.
Graduation: Has received a high school diploma, equivalency diploma, special diploma, or a certificate of high school completion.
GED Preparation: Must be enrolled in a study course for the Test of General Educational Development (GED) and meet attendance requirements.
Approved Educational Activities: Enrolled in educational activities approved by the district school board and satisfies attendance requirements.
Certificate of Exemption: must have a certificate of exemption under 1003.21(3).
Hardship Waiver: Has received a hardship waiver pursuant to F.S. 322.091.

The Department of Highway Safety and Motor Vehicles (DHSMV) will not issue a driver's license or learner’s permit if the minor fails to comply with these requirements, and may suspend a previously issued license or permit.

The DHSMV shall notify each student for whom the department has received notification of noncompliance with the requirements of this section as provided in F.S. 1003.27, and the student’s parent or guardian, of the department’s intent to suspend the minor’s driving privileges if they are found to be noncompliant with attendance requirements.

Once the student receives the notification for the intent to suspend driving privileges:

The student or their parent/guardian has 15 days to:

Provide proof of compliance by obtaining written verification from the school that the student has been in compliance for 30 days prior to the request for verification of compliance.
Request a hardship waiver hearing. The purpose of the hardship waiver is “for any minor under the school’s jurisdiction for whom a personal or family hardship requires that the minor have a driver’s license for his or her own, or his or her family’s, employment or medical care.”
To request a Hardship Waiver Hearing, please fill out this google form. Waiver hearings will be scheduled monthly at the district office. If a hardship waiver is denied, the DMV will suspend the minor’s license or permit, or record the minor's noncompliance.

If no response or proof of compliance is provided within 20 days of the notice, the DHSMV will Suspend the license or permit or record the student’s information if they do not have a license or permit so they will not be able to attain one.

Reinstatement of Driving Privileges:

The DHSMV may not issue a new license or permit unless the student submits the verification of compliance and reinstatement form (HSM 72870) or (HSM 72871) from the school district.

The student attends school for 30 consecutive days without any unverified absences.
- The count begins the first day after the last unexcused absence. If an unexcused absence occurs during the 30-day accumulation period, the count starts over.
The reinstatement of driving privilege/eligibility of licensure must either be notarized or have the school seal affixed to the reinstatement form.
The reinstatement fees must be paid directly to the DHSMV.
The form (HSM 72870 ) or (HSM 72871) will only be accepted within 30 calendar days of its completion.

If the minor is found out of compliance again, the DMV will suspend the license until the minor turns 18 or fulfills the requirements, whichever comes first.
